The Court of First Instance has ordered GEBE to begin correcting a dangerous exposed-cable situation at a property in Simpson Bay within four weeks.
The September 29th ruling followed a court inspection earlier this year, where the judge found conditions serious enough to require prompt corrective action.
GEBE must begin adjusting the cable route within the four-week period and could face a 1,000-dollar penalty for each day of non-compliance.
The court rejected the property holder’s request to have GEBE’s transformer station removed, finding that the utility has longstanding legal rights to use and access the installation.
The property holder must also allow GEBE reasonable access for maintenance and repairs.
In a separate issue, the court questioned why electricity to the property had been disconnected even though the account reportedly had a positive credit balance.
The judge did not make a final finding on that issue because it had not been fully argued, but suggested that GEBE consider restoring the connection to avoid further legal action.
Both sides were denied damages, and each must cover its own legal costs.
